Nicholas Le Poidevin has been in practice at the Chancery Bar since 1977. His practice is largely contentious and the focus is on trusts, wills and estates, and real property, together with the associated professional negligence and conflicts of laws. Trusts work includes:

  • complaints of breach of trust
  • failures to provide information
  • the extent of trustees’ powers and challenges to their exercise
  • the variation of trusts
  • Beddoe applications
  • questions about indemnities and
  • the removal of trustees

He has advised STEP on the implementation of the Third Money Laundering Directive in the U.K.

Work involving wills and estates includes:

  • disputes about what assets are part of the estate
  • claims for financial provision
  • the consequences for personal representatives of claims for damages against their estate
  • the incidence of inheritance tax
  • the construction of wills

Property work includes:

  • problems with title in unregistered conveyancing
  • ownership of the property of defunct organisations, such as schools and clubs
  • business tenancies
  • break clauses and rent review
  • easements, restrictive covenants and rights of common

Nicholas has appeared in courts in offshore jurisdictions, including the Isle of Man and the Cayman Islands, and also takes instructions for litigation or advice in Jersey, Guernsey and Bermuda. With other members of chambers, he is an editor of Lewin on Trusts (18th ed., 2008). He has lectured widely on matters within his practice and contributes articles to legal publications. He is a member of STEP and sits on its International Committee. He is a Commons Commissioner.
