Nicola Allsop

Nicola Allsop was called to the Bar in 2002, having obtained a first class honours degree in law from the University of Bristol.

Nicola has a modern commercial chancery practice with particular experience in personal and corporate insolvency, company law, professional negligence, landlord and tenant, real property and housing.

Nicola regularly appears in both the County Court and the High Court. She is often instructed on behalf of Trustees in Bankruptcy in proceedings for possession and sale of Bankrupt’s property in addition to applications relating to the ongoing management of bankruptcy estates, such as applications for orders re-directing a bankrupt’s post and for private examination of a Bankrupt’s affairs. In the Companies Court, Nicola regularly deals with matters arising from the presentation of winding-up petitions, such as applications for validation orders and for injunctions restraining the presentation or advertisement of petitions. Her reported insolvency cases include Kong and another v Inland Revenue and others [2005] All ER (D) 146 and Wade and another v Poppleton & Appleby (a firm) [2004] 1 BCLC 674.

Nicola has experience of being led and is currently involved in long-running litigation concerning a dispute over beneficial share ownership; Singh v Anand and others [2006] All ER (D) 153.

Nicola has appeared in the Court of Appeal in a case concerning the law of agency (Crook v Keen [2007] EWCA Civ 121) and was junior counsel in Crossley v City of Westminster [2006] HLR 26.

In relation to property law, Nicola is frequently instructed in landlord and tenant matters involving both commercial and residential property. She also advises and appears in ‘TOLATA’ cases and has acted in cases involving adverse possession, easements and disputes connected to beneficial interests in property concerning constructive trusts and proprietary estoppel.
